Privacy Policy

This Privacy Policy ("Policy") describes how Gush, Inc. ("Gush," "we," "us," or "our") collects, uses, stores, discloses, sells, and otherwise processes information about you when you access or use Gush.com and any related applications or services (collectively, the "Service"). By using the Service, you agree to the collection and use of your information as described in this Policy. If you do not agree, do not use the Service.

1. Information We Collect

We collect information in the following categories:

1.1 Information You Provide Directly

  • Account information: name, email address, profile photo (via Google OAuth)
  • Phone number: if you elect to receive SMS alerts
  • User-generated content: fragrance ratings, rankings, collection data, wishlist items, reviews, and any other content you submit
  • Communications: any messages, feedback, or other content you send to us

1.2 Information Collected Automatically

  • Usage data: pages visited, search queries, links clicked, time spent, scroll depth, and interaction patterns
  • Device and technical data: IP address, browser type and version, operating system, device identifiers, screen resolution, and language settings
  • Location data: approximate geographic location derived from your IP address; precise location if you grant permission
  • Referral data: the URL that referred you to our Service and URLs you navigate to after clicking our affiliate links
  • Transaction signals: whether you clicked a retailer link and subsequent purchase activity shared with us by affiliate networks
  • Cookies and tracking technologies: see Section 5 below

1.3 Inferred and Derived Information

We analyze and combine the information we collect to infer additional information about you, including your fragrance preferences, personality type, taste profile ("Scent DNA"), price sensitivity, shopping behavior, and predicted affinities. This derived data is a proprietary Gush asset and may be used and shared as described in this Policy.

1.4 Information from Third Parties

We may receive information about you from third parties, including social login providers (Google), affiliate networks, advertising partners, data brokers, and analytics providers. We may combine this information with data we have collected about you.

2. How We Use Your Information

We use the information we collect for any lawful purpose, including:

  • Providing, maintaining, and improving the Service
  • Personalizing your experience, including price alerts, recommendations, and taste profiling
  • Sending you price drop alerts, promotional offers, newsletters, and other marketing communications via email and SMS
  • Processing and fulfilling your requests and transactions
  • Conducting analytics, research, and product development
  • Training and improving our machine learning models, recommendation engines, and artificial intelligence systems
  • Building aggregated, anonymized, or pseudonymized datasets for internal and commercial use
  • Detecting and preventing fraud, abuse, and security incidents
  • Enforcing our Terms of Service and other agreements
  • Complying with legal obligations
  • Any other purpose disclosed to you at the time of collection or for which you have given consent

3. Sharing and Sale of Your Information

We share and, in certain cases, sell your personal information with the following categories of third parties:

  • Affiliate and retail partners: we share click, referral, and purchase signal data with affiliate networks and retailer partners for commission attribution and analytics purposes
  • Advertising partners: we share data with advertising networks and platforms to enable targeted advertising on and off the Service, including interest-based advertising
  • Analytics providers: we share data with analytics and measurement partners to understand usage and improve the Service
  • Data brokers and commercial partners: we may sell or license your personal information, including your taste profile, behavioral data, and derived attributes, to third parties for their own marketing, research, or commercial purposes
  • AI and technology partners: we may share your User Content and behavioral data with technology partners for the purpose of training, fine-tuning, and benchmarking machine learning models
  • Service providers: we share data with vendors who assist us in operating the Service, including hosting, email delivery, SMS, payment processing, and customer support
  • Business transfers: in connection with a merger, acquisition, sale of assets, financing, or other business transaction, your information may be transferred to a successor entity without restriction
  • Legal and safety purposes: we may disclose your information if required by law, subpoena, or other legal process, or if we believe disclosure is necessary to protect rights, property, or safety

We do not sell the personal information of users we know to be under 16 years of age without affirmative authorization.

4. Cookies and Tracking Technologies

We use cookies, web beacons, pixel tags, local storage, and similar tracking technologies to collect and store information about your interactions with the Service. These technologies allow us and our partners to recognize your device, remember your preferences, measure the effectiveness of our communications, deliver targeted advertising, and analyze usage patterns.

We use the following categories of cookies:

  • Strictly necessary: required for the Service to function
  • Performance and analytics: help us understand how users interact with the Service
  • Functional: remember your preferences and settings
  • Targeting and advertising: used by us and our partners to deliver relevant ads

Most browsers allow you to control cookies through settings. However, disabling certain cookies may impair the functionality of the Service. By continuing to use the Service, you consent to our use of cookies and tracking technologies.

5. SMS Communications

If you provide your mobile phone number, you consent to receive recurring automated marketing and informational text messages from Gush, including price alerts, promotional offers, and other updates. Consent is not a condition of purchasing any goods or services. Message and data rates may apply. Message frequency varies. Text STOP to any message to opt out. Text HELP for help. 6. Data Retention

We retain your personal information for as long as your account is active, as long as necessary to provide the Service, and for additional periods as required or permitted by law. We may retain anonymized or aggregated data derived from your information indefinitely. Deletion of your account does not guarantee immediate or complete deletion of all information associated with your account, including information that has been shared with third parties or incorporated into aggregated datasets.

7. Security

We implement reasonable technical and organizational measures designed to protect your information from unauthorized access, use, or disclosure. However, no security measure is perfect, and we cannot guarantee the absolute security of your information. You use the Service and transmit information at your own risk. In the event of a data breach, we will notify you as required by applicable law.

8. Children's Privacy

The Service is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If we become aware that we have collected personal information from a child under 13 without verifiable parental consent, we will take steps to delete that information. 9. Your Privacy Rights

Depending on your jurisdiction, you may have certain rights with respect to your personal information, including the right to access, correct, or delete your data, the right to opt out of the sale of your personal information, and the right to data portability. To exercise any available rights, please contact us at legal@gush.com. We will respond to verifiable requests within the timeframe required by applicable law. We may deny requests that are manifestly unfounded, excessive, or that conflict with our legal obligations.

Please note that even if you opt out of certain data sales or sharing, we may continue to use and share aggregated, anonymized, or de-identified data derived from your information.

10. California Privacy Rights

If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), including the right to know what personal information we collect, sell, or disclose, the right to opt out of the sale or sharing of your personal information, the right to delete your personal information (subject to exceptions), and the right to non-discrimination for exercising your rights.

11. International Users

The Service is operated from the United States. If you are located outside the United States, your information will be transferred to and processed in the United States, where data protection laws may differ from those in your jurisdiction. By using the Service, you consent to such transfer and processing.

12. Changes to This Policy

We reserve the right to modify this Policy at any time. Changes will be effective upon posting to the Service. Your continued use of the Service following any modification constitutes your acceptance of the revised Policy. We encourage you to review this Policy periodically.
